1. Acceptance of Terms

By downloading, installing, or using the BotanAI mobile application ("App") or accessing our website at botanai.app ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

2. Description of Service

BotanAI provides:

• Plant identification using on-device AI technology
• Plant disease diagnosis and care recommendations
• Plant care scheduling and reminders
• Community features for plant enthusiasts
• Optional premium features through in-app purchases

3. Account Registration

Some features require account creation. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

You must be at least 13 years old to create an account. Users under 18 should have parental consent.

4. User Conduct

When using BotanAI, you agree NOT to:

• Violate any applicable laws or regulations
• Post harmful, offensive, or inappropriate content
• Harass, abuse, or threaten other users
• Impersonate others or misrepresent your affiliation
• Upload malicious code or attempt to hack the service
• Scrape, copy, or redistribute our content without permission
• Use the service for commercial purposes without authorization
• Circumvent any access restrictions or security measures

We reserve the right to suspend or terminate accounts that violate these guidelines.

5. User Content

"User Content" includes photos, text, and other materials you submit to BotanAI.

5.1 Ownership

You retain ownership of your User Content. By sharing content in community features, you grant BotanAI a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within our services.

5.2 Responsibility

You are solely responsible for your User Content. You represent that you have all necessary rights to share any content you post.

5.3 Local Photos

Photos used for plant identification remain on your device and are not considered User Content unless you explicitly share them.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTANAI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for premium features in the 12 months preceding the claim, or $100, whichever is greater.

8. Premium Features and Payments

8.1 Subscriptions

BotanAI Pro is offered as an auto-renewing subscription. You authorize us to charge your payment method on a recurring basis.

8.2 Cancellation

You may cancel your subscription at any time through Google Play. Cancellation takes effect at the end of the current billing period.

8.3 Refunds

Refunds are handled according to Google Play's refund policy. Contact support@botanai.app for assistance.

9. Intellectual Property

The BotanAI name, logo, and all related content, features, and functionality are owned by BotanAI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without explicit permission.

10. Third-Party Services

BotanAI integrates with third-party services including Plant.id, Firebase, and Google Play. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third parties.

11. Termination

We may suspend or terminate your access to BotanAI at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately.

You may terminate your account at any time by contacting support@botanai.app or using the account deletion feature in the app.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

13. Dispute Resolution

Before filing a claim, you agree to contact us at support@botanai.app to attempt informal resolution. If we cannot resolve the dispute within 30 days, either party may pursue formal proceedings.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
